What should I pay attention to when changing an order?

We need the bonprix customer number and the order date to be able to check the orders individually. Please do not send us customer names or e-mail addresses. For privacy reasons, we cannot search our systems for customer names or email addresses. Claims will only be accepted up to 6 months after the order date.

What does Session Freeze mean?

This means that a session for a tracking URL will be locked for 60 minutes. For example, in the case of an affiliate, it looks like this: If a user clicks on a link in one of our newsletters, that session will be locked for 60 minutes. If, during these 60 minutes, the user visits our shop, selects a product, looks for a voucher code or redeems cashback points through one of our affiliates, the purchase will be attributed to the newsletter channel and not to the affiliate. Only if the customer clicks on an affiliate link after the 60 minutes and makes a purchase will the revenue be attributed to the affiliate.

This particularly affects cashback sites. To prevent this from happening, all cashback partners must add the following information to their sites so that customers know how to get their cashback points:

General tips for collecting points at bonprix:

- Do not visit other websites during the order process and do not redeem vouchers or discounts from other websites.

- Points are usually only credited on the net order value of the purchase.

- No points can be credited for shipping costs, interest on hire purchase and redeemed vouchers.

- Points are posted when the goods or services received are fully paid for and the return period has expired - usually within 75 days of purchase.

- If the goods are returned or the service is not used, the points reserved are cancelled.

Our eligibility criteria:

Publishers must always have a website with an imprint (exception: Influencers), be fully capable of conducting business and be at least 18 years old.

The content of the website must be in the language of the programme. (English for DE)

The website must be accessible. (no websites under construction)

The content of the website must not contain anything illegal or objectionable. (Pornography, illegal content, anorexia, politically motivated, gambling, pyramid schemes, etc.)

The target audience of the website must be compatible with bonprix.

Cashback: On cashback/reward sites, it should always be clear that the customer receives discounts, points or similar from the website and not from bonprix.

The website must have its own content. (no mere aggregation of banners or other content)

Sites with long loading times will not be accepted.

Click coercion: Sites with click prompts or click coercion will not be accepted.

Redirection: A redirect to bonprix is only permitted if a visible, registered affiliate landing page has been set up for the user. Automatic and misleading redirects directly to bonprix are not permitted.

Sub-networks are not accepted.

Conditions of participation for the placement of advertising material for www.bonprix.es within the framework of the bonprix partner program

§1 Conclusion of contract

A contract between bonprix and a partner for the placement of bonprix advertising material is concluded exclusively via the application process of the partner platform, in which the partner submits an offer to participate in the bonprix partner program and accepts these terms and conditions. The partner is not entitled to accept this offer or to conclude a contract with bonprix. The partner platform will inform the partner of his or her acceptance into the bonprix partner program.

§ 2 Subject matter

1) The subject matter of these terms and conditions is participation in the partner program and advertising on the following domains: www.bonprix.de by the partner as a publisher within the framework of the affiliate platform. bonprix makes a selection of advertising material available to the partner as an advertiser via the partner program for this purpose.

2) The partner is responsible for placing the bonprix advertising material on his website(s) registered in the bonprix partner program (hereinafter referred to as the "partner website"). The partner is free to decide whether and for how long to place the bonprix advertising material on the partner website. The partner is entitled to remove the bonprix advertising material at any time.

3) bonprix reserves the right to amend these conditions at any time. The partner will be notified of any changes by e-mail. If the partner does not agree with the changes, he/she is entitled to inform bonprix of this within four weeks of receipt of the notification of change. If the partner does not notify bonprix within this period, the changes shall be deemed to have been accepted and shall take effect upon expiration of the period. bonprix shall draw the partner's attention to the significance of the four-week period in the notification of changes.

§ 3 Structure and Maintenance of the Partner Website

1) The Partner is provided with a selection of graphic and text links (hereinafter referred to as "links") via the Partner Platform for contract-specific use. The partner is responsible for placing the bonprix advertising material on his website(s) registered in the bonprix partner program. The partner is free to decide whether and for how long the bonprix advertising material is to be placed on the partner's website. The partner is entitled to remove the bonprix advertising material at any time.

2) The partner assures that cookies will only be set if an advertising medium provided by the bonprix partner program is visibly used on the partner website and a voluntary and conscious click is made by the user. The use of layers, add-ons, iFrames, pop-ups, pop-unders and post-view technology is generally not permitted and strictly prohibited.

Logging into adware networks is also prohibited. Orders generated by indicating to the user that bonus points or other additional rewards or bonuses can still be "taken" will not be tolerated and sales made in this manner will be canceled. Only sales that have a legitimate origin resulting from a regular marketing activity on your website/advertising space will be compensated.

3) The use of forced clicks and paid mails is prohibited.

4) The links may only be integrated into the website whose address (URL) the partner specified when registering for the bonprix partner program. The links serve to identify the partner website within the bonprix partner network and to establish a connection from the partner website to the bonprix website. A connection to the bonprix website may only be established via these links. The links may refer to different areas of the bonprix website.

5) Operators of reimbursement systems with a monthly or annual fee may not participate in the bonprix partner program.

6) With regard to the technical setup and maintenance of the links, the partner must strictly follow the instructions for the installation of the links. To ensure correct billing, the partner may only use the links provided by bonprix.

7) The maintenance of the partner website is the sole responsibility of the partner. As long as the partner uses the bonprix links, he will regularly update the information and links in connection with bonprix products and delete outdated links and content, unless these are dynamically maintained or changed by bonprix. The partner is obliged to check his website at least once a week for any changes to the information and links.

§ 4 Calculation of advertising revenue

1) When calculating the advertising remuneration, only bonprix's income from sales of bonprix products to customers who have accessed the bonprix website immediately before the purchase via one of the links on the partner's website and who are coded as affiliate marketing by the tracking logic used by bonprix shall be taken into account. Such sales will be taken into account in the calculation of the advertising fee, provided that the sale, delivery and full payment of the goods have been completed, less returns, VAT and credit notes.

2) Payment of the advertising fee shall be made when the invoice has been paid by the Customer and the Customer's right of withdrawal has expired. In the event of complete or partial returns by the Customer, no or only a pro rata advertising fee shall be paid. In the mail-order business, it may take up to 11 weeks to order payment of the advertising fee, also due to the return period.

3) Orders placed by customers and employees of the bonprix Group who are entitled to commission are not included in the calculation of your advertising fee.

4) Income from our foreign companies is not taken into account when calculating the advertising fee.

§ 5 Rights of use

(1) The Partner shall receive a non-exclusive, non-transferable right, which may be revoked at any time, to access the bonprix website via the agreed links. Exclusively in connection with such links, the Partner shall have the right to use the bonprix logo and other materials provided for the purpose of advertising the bonprix website. This right only applies for the purpose of creating links between the partner's website and the bonprix website that enable users to purchase bonprix products. The partner may not revise or modify the licensed material in any way. Any violation of the aforementioned agreements entitles bonprix to terminate the contract without notice.

(2) The rights under Section 5.1 expire upon the effective date of termination of this Agreement.

§ 6 Conditions of participation

1) The Partner is responsible for the content and the ongoing operation of its Partner Website and shall not, during the term of this Agreement, place any content there that violates applicable law, common decency or the rights of third parties. Prohibited content includes, but is not limited to, depictions of violence, sexual and pornographic content and images, misleading statements, or discriminatory content (e.g., based on gender, race, politics, religion, nationality, or disability).Such content may not be mentioned on the affiliate website itself, nor may the affiliate website link to such content on other websites.

2) The partner is prohibited from maintaining websites on the Internet that could be mistaken for the bonprix website. The partner may neither mirror nor adopt graphics, texts or other content from the bonprix website.

In particular, the impression must not be given that the partner website is a bonprix project or that its operator is economically connected to bonprix in a way that goes beyond the bonprix partner program and this contract. Any use of materials or content from the bonprix website and its logos or trademarks by the partner requires the prior written consent of bonprix.

The words "bonprix" or "bonprix.es" may not appear in the domain name or meta text of the partner website. The partner is not permitted to register characters similar to "bonprix" (e.g. typos) as domain names and/or to advertise via "Adsense".

Redirects to bonprix websites are prohibited.

3) Search engine marketing and other keyword-based advertising for the bonprix brand, bonprix misspelling and own brands is not permitted.

When advertising the partner website on advertising spaces in search engines or sponsored links, paid ad placements, keyword advertising, keyword targeting with providers such as Google, Bing, etc., the following must be observed

The words "bonprix" and "bonprix.es" may only be used with the written permission of bonprix.

If permission has been granted by bonprix, the words "bonprix" and "bonprix.es" may only be used in the text of the advertisement, but not in the headline. The partner may only use the address (URL) as a visible URL in the advertisement that the partner has specified as part of his registration.

In case of domain change, see section 6.5.

Direct redirects to the bonprix website are not permitted. If bonprix has granted permission to bid on keywords in connection with bonprix, only keywords approved by bonprix may be bid on. Bidding on the keyword "bonprix" as well as word combinations and compounds with the words "shipping", "catalog", "store" and "de" (e.g. "bonprix shipping", "bonprixshipping", "bonprix catalog", "bonprix.es", "bonprixes", bonprix coupons, etc.) and similar spellings is not permitted.

By participating in the bonprix partner program, the partner agrees to register the keywords "bonprix" and "bon prix" as negative with the search engine providers.

In the event of non-compliance with the aforementioned restrictions, bonprix is entitled to terminate the contract without notice and to cancel all commissions generated by these violations. The right to assert further claims for damages is expressly reserved.

4) The partner is not authorized to create or accept offers on behalf of bonprix or to represent bonprix. The partner is only entitled to send e-mails advertising bonprix and/or bonprix products to end customers on behalf of bonprix or in his own name with the written consent of bonprix. The partner is not involved in the processing of sales contracts between bonprix and its end customers. The Partner will not act as a commercial agent or commission agent for bonprix.

The Partner shall ensure that the design of the Partner Website does not give this impression. The Partner may not make any statements to third parties that could give such an impression.

5) The partner may only place the bonprix links on the website whose address (URL) he has specified as part of this registration. In the event of a change in the domain of the partner's website, a change in the content of the partner's website or a change in the commercial purpose of the partner's website, the partner must inform bonprix one month in advance. The continued placement of links under the new domain is permitted as long as bonprix does not object to this use.

The same applies in the event of a change in the content or commercial purpose of the partner website.

6) The partner operates its website independently, is responsible for its content in accordance with § 8 of the German Teleservices Act (TDDSG) and complies with the provisions and obligations of the German Teleservices Data Protection Act (TDDSG) (in particular, the partner is solely responsible for compliance with the relevant provisions of the TDDSG regarding the storage of cookies) and the German Data Protection Act (BDSG) and indemnifies bonprix from all claims that may arise for bonprix as a result of a violation of data protection laws for which the partner is responsible.

7) Commercial orders will not be compensated.

8) Advertising materials provided or approved for one affiliate segment may not be transferred to or used in another affiliate segment.

9) Orders placed through onestop shopping affiliates will not be compensated.

10) The partner may only advertise vouchers that bonprix has explicitly released for affiliates and/or communicated via partner newsletters. The advertising of other vouchers, e.g. from end customer newsletters, print advertisements or customer service contacts, is not permitted.

Violations will result in the cancellation of all transactions.

When advertising coupons, the affiliate will always state the terms and conditions for redeeming the coupon. This includes the offer itself, the activation date and, if applicable, the deactivation date. Sites that list discount codes must explicitly distinguish between deals/group deals/offers/sales and coupon codes.

If a code has expired, it must be removed from the site or at least made clear that the code is no longer valid.

Simply stating the expiration date is not sufficient.

The promotion of the coupon must comply with the law. The promotion must not be misleading. An advertisement is considered misleading if, contrary to the information on the website, no valid coupon codes appear. It is also misleading if the affiliate's website opens without prompting.

11) The partner must remove bonprix advertising material from the partner website immediately upon request by bonprix.

12) Partner applications may not contain exclusively bonprix content. The use of print screens with the bonprix logo and/or bonprix CI/branding in the Apple App Store, Google Play Store, Windows Store or other app platforms is not permitted. The partner app may not use bonprix as a keyword or in its description.

13) Only one order per session will be compensated. If a customer leaves the store within an active session and visits another affiliate site, the cookie set will not be overwritten and the marketing channel that first brought the customer to the store will receive the commission.

14) The partner is not authorized to create, accept or present bonprix offers in social networks in the name of bonprix without prior approval. Furthermore, it is not permitted to place any form of advertising on such platforms that links directly to the bonprix website - either as plain text or in conjunction with the bonprix logo.

In the event of an infringement, the affiliates concerned will be removed from the program on the basis of the partner link and there will be no entitlement to commissions generated in this way.

15) The partner is obliged to indemnify bonprix from any claims by third parties and the costs of defending against claims by third parties in connection with the creation, operation or maintenance of the partner website and the content for which the partner is responsible, unless the claims relate to the advertising material or product data provided by bonprix and the partner has complied with its obligation to update in accordance with § 4.7. The partner is also obliged to support bonprix in defending itself against such third-party claims by submitting declarations, in particular statutory declarations, and by providing other information. The partner shall refrain from all actions that impair the functionality of the software or the system (e.g. mail bombs, etc.) and shall be liable for all damages incurred by bonprix as a result of such actions by the partner.

16) Any violation of the program rules by a partner registered for the bonprix partner program can lead to immediate exclusion from the bonprix partner program without prior notice and to the cancellation of all pending sales. Further legal steps, in particular the assertion of claims for damages, are expressly reserved.

§ 7 Warranty and liability

1) bonprix operates its website within the scope of its technical capabilities. bonprix makes no assurances or guarantees with regard to the partner network, bonprix products or the error-free and uninterrupted usability of the bonprix website.

2) In the event of intent or gross negligence, including that of our legal representatives and vicarious agents, bonprix shall be liable in accordance with the statutory provisions.

The same applies to culpably caused damages resulting from injury to life, body or health, to damages resulting from the absence of a warranted characteristic as well as in the case of fraudulently concealed defects. In the case of damage to property and financial losses caused by bonprix, its legal representatives or vicarious agents through slight negligence, bonprix is only liable in the event of a breach of a material contractual obligation, but the amount of liability is limited to the damage foreseeable at the time of conclusion of the contract and typical for the contract. Material contractual obligations are those whose fulfillment makes the proper execution of the contract possible in the first place and on whose fulfillment the contracting parties regularly rely and may rely. Liability in accordance with the Product Liability Act remains unaffected. Liability on the part of bonprix is otherwise excluded.

§ 8 Confidentiality

1) Except as otherwise provided in this Agreement or with the consent of the other party, all information, including but not limited to the terms of this Agreement, business and financial information, customer and supplier lists, and price and sales information, shall be treated as strictly confidential. Such confidential information may not be used by the other party either directly or indirectly for its own commercial purposes or for any other purpose.

2) Press releases concerning the cooperation based on this contract must be coordinated with bonprix and require the written consent of bonprix prior to publication.

3) This does not apply if such information is known or accessible to the general public through generally accessible sources that are not the sources of the respective party. Irrespective of this provision, each party is entitled to pass on a copy of such information if there is a corresponding court or administrative order, if the disclosure to accountants, lawyers or other obligated parties is on a confidential basis or if there is a legal obligation to do so.

Condiciones de participación para colocar material publicitario de www.bonprix.es como parte del programa de afiliación de bonprix

Art. 1 Celebración del contrato

Los contratos entre bonprix y un afiliado sobre la colocación de material publicitario de bonprix se celebrarán exclusivamente mediante el procedimiento de solicitud de la plataforma de afiliación. Durante dicho procedimiento, el afiliado presentará una oferta para participar en el programa de afiliación de bonprix y aceptará las presentes condiciones. El afiliado tendrá derecho a no aceptar esta oferta y a no firmar el contrato con bonprix. La plataforma de afiliación informará al afiliado sobre la aceptación en el programa de afiliación de bonprix.

Art. 2 Objeto

1) El objeto de las presentes condiciones es la participación en el programa de afiliación y la publicidad en los siguientes dominios: www.bonprix.de por parte del afiliado como editor en el marco de la plataforma de afiliación. bonprix facilita al afiliado una selección de material publicitario como anunciante a través del programa de afiliación.

2) El afiliado colocará el material publicitario de bonprix en sus sitios web registrados en el programa de afiliación de bonprix (en lo sucesivo, «sitio web del afiliado») bajo su propia responsabilidad. El afiliado podrá decidir libremente si coloca el material publicitario de bonprix en el sitio web del afiliado y durante cuánto tiempo. También tendrá derecho a retirar el material publicitario de bonprix en cualquier momento.

3) bonprix se reserva el derecho a adaptar las presentes condiciones en cualquier momento. Se notificará al afiliado cualquier modificación por correo electrónico. Art. 3 Estructura y mantenimiento del sitio web del afiliado

1) Se proporcionará al afiliado una selección de enlaces gráficos y textuales (en lo sucesivo, «enlaces») para uso específico del contrato a través de la plataforma de afiliación. El afiliado colocará el material publicitario de bonprix en sus sitios web registrados en el programa de afiliación de bonprix bajo su propia responsabilidad. El afiliado podrá decidir libremente si coloca el material publicitario de bonprix en el sitio web del afiliado y durante cuánto tiempo. También tendrá derecho a retirar el material publicitario de bonprix en cualquier momento.

2) El afiliado garantiza que las cookies únicamente se instalarán si se utiliza un material publicitario proporcionado por el programa de afiliación de bonprix en el sitio web del afiliado y el usuario hace clic de forma voluntaria y consciente. En general, queda estrictamente prohibido utilizar capas, complementos, iFrames, ventanas emergentes, ventanas inferiores y tecnología posterior al visualizado.

Además, queda prohibido registrarse en redes de adware. Los enlaces sirven para identificar el sitio web del afiliado dentro de la red de afiliados de bonprix y establecer la conexión entre el sitio web del afiliado y el sitio web de bonprix. La conexión con el sitio web de bonprix únicamente puede establecerse a través de estos enlaces. Los enlaces pueden hacer referencia a diferentes áreas del sitio web de bonprix.

5) Las empresas operadoras de sistemas de reembolso con una cuota mensual o anual no pueden participar en el programa de afiliación de bonprix.

6) El afiliado debe respetar las instrucciones para crear enlaces en lo que respecta a la configuración técnica y el mantenimiento. El afiliado solo utilizará los enlaces proporcionados por bonprix con el objetivo de garantizar una contabilización correcta.

7) El mantenimiento del sitio web del afiliado es responsabilidad exclusiva de dicho afiliado. Mientras el afiliado utilice los enlaces de bonprix, actualizará regularmente la información y los enlaces relacionados con los productos de bonprix y eliminará los enlaces y contenidos obsoletos, a menos que bonprix no los mantenga o modifique dinámicamente. El afiliado está obligado a comprobar su sitio web al menos una vez a la semana para detectar posibles modificaciones en la información y los enlaces.

Art. 4 Cálculo de los ingresos por publicidad

1) A fin de calcular la remuneración por publicidad, únicamente se tendrán en cuenta los ingresos de bonprix derivados de ventas de productos de bonprix a clientes que hayan seleccionado el sitio web de bonprix inmediatamente antes de comprar a través de uno de los enlaces del sitio web del afiliado y que estén categorizados como marketing de afiliación por la lógica de seguimiento utilizada por bonprix. Dichas ventas se tendrán en cuenta para calcular la remuneración por publicidad siempre que se haya completado la venta, la entrega y el pago íntegro de los bienes, menos las devoluciones, el IVA y las notas de crédito.

2) El pago de la remuneración por publicidad se transferirá cuando el cliente haya abonado la factura y haya expirado el derecho de revocación del cliente. En caso de devoluciones totales o parciales por parte del cliente, no se abonará ninguna remuneración por publicidad o solo se abonará una cantidad proporcional. En el caso de las ventas por correo, la transferencia del pago de la remuneración por publicidad puede tardar hasta 11 semanas, también debido al plazo de devolución.

3) Los pedidos realizados por clientes y empleados del grupo bonprix con derecho a comisión no se tienen en cuenta para calcular la remuneración por publicidad.

4) Los ingresos de nuestras sociedades extranjeras no se tienen en cuenta para calcular la remuneración por publicidad.

Art. 5 Derechos de uso

(1) El afiliado recibe un derecho no exclusivo, intransferible y revocable en cualquier momento para acceder al sitio web de bonprix a través de los enlaces acordados. Únicamente en relación con dichos enlaces, el afiliado tendrá derecho a utilizar el logotipo de bonprix y otros materiales facilitados con el fin de promocionar el sitio web de bonprix. Este derecho solo se aplica para crear enlaces entre el sitio web del afiliado y el sitio web de bonprix que permitan a los usuarios adquirir productos bonprix. El afiliado no podrá revisar ni modificar los materiales bajo licencia. El incumplimiento de los acuerdos mencionados dará derecho a bonprix a rescindir el contrato sin previo aviso.

(2) Los derechos de la cláusula 5.1 expirarán cuando se haga efectiva la rescisión del presente acuerdo.

Art. 6 Condiciones de participación

1) El afiliado será responsable del contenido y del funcionamiento continuo de su sitio web de afiliado y, durante la vigencia del presente contrato, no incluirá en él ningún contenido que infrinja la legislación aplicable, las buenas costumbres o los derechos de terceros. Quedan prohibidas (sin limitarse a ello), en particular, las representaciones que exalten la violencia, el contenido y las imágenes sexuales y pornográficas, las declaraciones engañosas o el contenido discriminatorio (por ejemplo, en relación con el sexo, la raza, la política, la religión, la nacionalidad o la discapacidad). Dichos contenidos no podrán mencionarse en el propio sitio web del afiliado, ni el sitio web del afiliado podrá enlazar a dichos contenidos en otros sitios web.

2) El afiliado tiene prohibido mantener sitios web en Internet que puedan llevar a una confusión con el sitio web de bonprix. El afiliado no está autorizado a reflejar el sitio web de bonprix ni a adoptar gráficos, textos u otros contenidos del sitio web de bonprix. En concreto, debe evitarse la impresión de que el sitio web del afiliado constituye un proyecto de bonprix o que su empresa explotadora está económicamente relacionada con bonprix de una forma que va más allá del programa de afiliación de bonprix y del presente contrato. Cualquier uso de materiales o contenidos del sitio web de bonprix y de sus logotipos o marcas por parte del afiliado requiere la autorización previa por escrito de bonprix.

El afiliado no distribuirá ningún otro material publicitario relacionado directa o indirectamente con bonprix sin haberlo presentado previamente a bonprix y haber recibido una autorización por escrito. La autorización mencionada deberá obtenerse especialmente si el afiliado hace publicidad en un sitio web de terceros o en otros medios para el sitio web del afiliado mediante los materiales mencionados o haciendo referencia a bonprix. El afiliado debe asegurarse de que el sitio web de afiliado o la publicidad no se perciban como un sitio web de bonprix o como publicidad colocada por bonprix mediante el uso de los materiales publicitarios mencionados o del nombre bonprix.

El nombre de dominio y el metatexto del sitio web del afiliado no contendrán las palabras «bonprix» ni «bonprix.es». El afiliado no está autorizado a registrar caracteres similares a «bonprix» (por ejemplo, con errores tipográficos) como nombres de dominio o hacer publicidad a través de «Adsense». Quedan prohibidos los redireccionamientos a páginas de Internet de bonprix.

3) No se permite el marketing en motores de búsqueda ni otro tipo de publicidad basada en palabras clave para la marca bonprix, bonprix Vertipper y sus marcas propias.

En caso de publicitarse el sitio web del afiliado en espacios publicitarios de motores de búsqueda o enlaces patrocinados, espacios de pago, publicidad por palabras clave, segmentación por palabras clave con proveedores como Google, Bing, etc., deberá tenerse en cuenta lo siguiente:

Las palabras «bonprix» y «bonprix.es» solo podrán utilizarse con la autorización por escrito de bonprix. Si bonprix autoriza dicho uso, las palabras «bonprix» y «bonprix.es» solo podrán utilizarse en el texto del anuncio, pero no en el título.

El afiliado solo podrá utilizar la dirección (URL) como URL visible en el anuncio que el afiliado haya especificado al inscribirse. En caso de cambio de dominio, se debe consultar la cláusula 6.5.

No se permiten los redireccionamientos directos al sitio web de bonprix.

Si bonprix ha autorizado optar por palabras clave en relación con bonprix, solo se permite optar por palabras clave autorizadas por bonprix. No se permite optar por la palabra clave «bonprix», así como por combinaciones de palabras y compuestos con las palabras «envío», «catálogo», «tienda» y «bonprixes» (por ejemplo, «envío de bonprix», «envío bonprix», «catálogo de bonprix», «bonprix.es», «bonprix.es», «vales de bonprix», etc.) y similares. Al participar en el programa de afiliación de bonprix, el afiliado acepta registrar las palabras clave «bonprix» y «bon prix» como negativas con los proveedores de motores de búsqueda.

En caso de incumplirse las restricciones mencionadas, bonprix tiene derecho a rescindir el contrato sin previo aviso y a cancelar todas las comisiones generadas por dichas infracciones. Queda expresamente reservado el derecho a reclamar daños y perjuicios.

4) El afiliado no puede crear o aceptar ofertas en nombre de bonprix ni representar a bonprix. El afiliado solo puede enviar correos electrónicos con publicidad de bonprix o productos de bonprix a clientes finales en nombre de bonprix o en su propio nombre con el permiso por escrito de bonprix. El afiliado no participará en la gestión de contratos de venta entre bonprix y sus clientes finales. El afiliado no actuará como agente comercial o comisionista de bonprix. El afiliado se asegurará de que el diseño del sitio web del afiliado no de tal impresión. El afiliado no hará declaraciones a terceros que puedan dar tal impresión.

5) El afiliado solo podrá colocar los enlaces de bonprix en el sitio web cuya dirección (URL) haya especificado al inscribirse. En caso de cambio del dominio del sitio web del afiliado, de cambio del contenido del sitio web del afiliado o del objeto comercial del sitio web del afiliado, el afiliado deberá informar a bonprix con un mes de antelación. La colocación continuada de enlaces en el nuevo dominio se permite si bonprix no se opone a dicho uso. Lo mismo se aplica en caso de modificarse el contenido o el objeto comercial del sitio web del afiliado.

6) El afiliado opera su sitio web de forma independiente, es responsable del contenido en el sentido del art. 8 de la ley TDG y respeta las normativas y obligaciones de TDDSG (en concreto, el afiliado es el único responsable de respetar las normativas pertinentes de la TDDSG con respecto al almacenamiento de cookies), BDSG y exime a bonprix de todas las reclamaciones en las que bonprix pueda incurrir como resultado de una infracción de las leyes de protección de datos por parte del afiliado.

7) Los pedidos comerciales no conllevan remuneración.

8) El material publicitario proporcionado o autorizado para un segmento de afiliados no podrá transferirse ni utilizarse en otro segmento de afiliados.

9) No se remunerarán los pedidos realizados a través de colaboradores integrales.

10) El afiliado solo podrá anunciar vales que bonprix haya emitido explícitamente para afiliados o comunicado a través de boletines informativos a afiliados. No se permite anunciar otros vales, por ejemplo, de boletines a clientes finales, anuncios impresos o contactos del servicio de atención al cliente. En caso de infracción, se cancelarán todas las transacciones.

Al anunciar vales, el afiliado siempre indicará las condiciones para canjear el vale en cuestión. Esto incluye la propia oferta, la fecha de activación y, si procede, la fecha de desactivación. Los sitios web que especifiquen códigos de descuento deben diferenciar explícitamente entre deals/groupdeals/offers/sales y códigos de vale.

Si un código ha caducado, debe retirarse del sitio web o, al menos, debe quedar claro que el código ya no es válido. No basta con indicar la fecha de caducidad.

La publicidad del vale debe cumplir las disposiciones legales. La publicidad no debe ser engañosa. Se considera que la publicidad es engañosa si, contrariamente a la información del sitio web, no aparece ningún código de vale válido. También es engañosa si el sitio web del afiliado se abre sin avisar.

11) El afiliado retirará inmediatamente el material publicitario de bonprix del sitio web del afiliado si se lo solicita bonprix.

12) Las aplicaciones del afiliado no pueden presentar exclusivamente contenido de bonprix. No se permite utilizar pantallas de impresión con el logotipo de bonprix o el CI/marca de bonprix en Apple App Store, Google Play Store, Windows Store u otras plataformas de aplicaciones. La aplicación del afiliado no podrá utilizar bonprix como palabra clave ni en su descripción.

13) Solo se remunerará un pedido por sesión. Si un cliente vuelve a salir de la tienda en línea durante una sesión activa y visita otra página del afiliado, la cookie establecida no se sobrescribirá y recibirá la comisión el canal de marketing que llevó por primera vez al cliente a la tienda en línea.

14) El afiliado no puede representar a bonprix ni crear o aceptar ofertas en nombre de bonprix en redes sociales sin autorización previa. Además, no está autorizado a colocar ningún tipo de anuncios en dichas plataformas que enlacen directamente con el sitio web de bonprix (ni como texto puro ni en relación con el logotipo de bonprix). En caso de infracción, se eliminará a los afiliados afectados del programa en base al enlace de afiliado, de forma que no tendrán derecho a las comisiones generadas de esta forma.

15) El afiliado está obligado a indemnizar a bonprix por cualquier reclamación de terceros y por los costes asociados a la defensa contra reclamaciones de terceros en relación con el establecimiento, funcionamiento o mantenimiento y contenido del sitio web del afiliado del que el afiliado sea responsable, a menos que las reclamaciones hagan referencia al material publicitario o a los datos del producto proporcionados por bonprix y que el afiliado haya cumplido con su obligación de actualización de acuerdo con el art. 4.7. El afiliado también está obligado a brindar asistencia a bonprix durante la defensa contra dichas reclamaciones de terceros mediante la presentación de declaraciones, en particular declaraciones juradas, y mediante la aportación de información adicional. El afiliado se abstendrá de toda acción que perjudique la funcionalidad del software o del sistema (por ejemplo, envío masivo de correos, etc.) y asumirá la responsabilidad de todos los daños y perjuicios ocasionados a bonprix como consecuencia de dichas acciones causadas por el afiliado.

16) Cualquier infracción de las normas del programa por parte de un afiliado inscrito en el programa de afiliación de bonprix puede conllevar la exclusión inmediata del programa de afiliación de bonprix sin previo aviso y a la cancelación de todas las ventas pendientes. Además, quedan expresamente reservadas otras acciones legales, en concreto la reclamación de daños y perjuicios.

Art. 7 Garantía y responsabilidad

1) bonprix opera su sitio web dentro sus capacidades técnicas. bonprix no ofrece ninguna seguridad ni garantía en relación con la red de afiliados, los productos de bonprix y la posibilidad de uso sin errores ni interrupciones del sitio web de bonprix.

2) En caso de dolo y negligencia grave, incluida la de nuestros representantes legales y agentes indirectos, bonprix será responsable conforme a las disposiciones legales. Esto también se aplica a los daños causados de forma dolosa por lesiones a la vida, el cuerpo o la salud, a los daños causados por la ausencia de una propiedad garantizada, así como en caso de defectos ocultados fraudulentamente. En caso de daños materiales y patrimoniales causados por bonprix, sus representantes legales o agentes indirectos por negligencia leve, bonprix solo asumirá responsabilidad en caso de incumplir una obligación contractual esencial, pero su importe se limitará a los daños previsibles en el momento de la celebración del contrato y típicos del mismo. Las obligaciones contractuales esenciales son aquellas cuyo cumplimiento resulta esencial para la correcta ejecución de un contrato y en cuyo cumplimiento las partes contratantes confían y pueden confiar. La responsabilidad en virtud de la ley alemana de responsabilidad por productos defectuosos no se ve afectada. Por lo demás, queda excluida la responsabilidad de bonprix.

Art. 8 Confidencialidad

1) Salvo que se disponga lo contrario en el presente acuerdo o cuenta con el consentimiento de la otra parte, toda la información, en particular las disposiciones del presente acuerdo, la información comercial y financiera, las listas de clientes y proveedores, así como la información sobre precios y ventas, se tratará como estrictamente confidencial. El afiliado no podrá utilizar ni directa ni indirectamente dicha información confidencial para sus propios fines comerciales ni para otros fines.

2) Los comunicados de prensa relativos a la cooperación basada en el presente contrato deberán coordinarse con bonprix y requerirán el consentimiento por escrito de bonprix antes de su publicación.

3) Esto no se aplicará si dicha información es conocida o accesible para el público general a través de fuentes de acceso general que no sean las fuentes de la parte en cuestión. Independientemente de esta disposición, cada parte tiene derecho a enviar una copia de dicha información si existe una orden judicial o administrativa correspondiente, si la información se transmite a contables, abogados u otras partes obligadas de forma confidencial o si existe una obligación legal para ello.
