General Terms and Conditions of Participation of the Affiliate Program
Date: 11/03/2023

Definitions 
The affiliate program offered by Novoline.de (hereinafter referred to as “Novoline.de”) is hereinafter referred to as the 
“Affiliate Program”. The participants of the Novoline.de program is hereinafter referred to as “Affiliates”. Affiliated 
networks are referred to as “Affiliate Networks”. 


Participation in the Affiliate Program

a. All participants of the Affiliate Program must be at least 18 years old and have full legal capacity. 

b. Participation in the Affiliate Program shall only be concluded upon confirmation of the Affiliate’s application by 
Novoline.de and may be terminated by either party at any time without giving reasons. 

c. The Affiliates undertake to keep their contact details stored in the Affiliate Network up to date. Such contact details 
include, in particular, their e-mail address and telephone number, in order to allow for quick contact. 

d. The Affiliates undertake to disclose the manner of their sales activities to Novoline.de upon request. This includes in 
particular detailed documentation by the Affiliates as to how registrations assigned to them came about and in what 
way the visits to the Novoline.de online presence (traffic) arranged by the Affiliate were generated. 

e. The Affiliates themselves are responsible for ensuring that their websites comply with copyrights, applicable 
trademark law, gaming law and other legal regulations. Any liability on the part of Novoline.de is excluded. The 
Affiliates shall indemnify Novoline.de against any claims asserted by third parties. 


Affiliate Groups 

In connection with the integration of advertising materials and other online marketing activities, certain Affiliate groups a re 
deemed inadmissible or critical for Novoline.de due to the sensitive subject matter and strict requirements imposed by the 
legislators. The following Affiliate groups are deemed inadmissible or critical in the context of the State Treaty on Gaming 
(GlüStV) and possible future advertising restrictions: 

a. Mailing and paid mailing partners
Mailing and paid-mailing partners are Affiliates who send out advertising e-mails. In particular in the case of paidmailing partners who send advertising e-mails for which the recipient receives remuneration from the paid-mailing 
partner, the recipient of the advertising e-mails must have expressly declared his or her interest into the sender. Beside
the legal provisions for sending newsletters (double opt-in) apply, as well the special provisions of the GlüStV and the 
GGL (Gemeinsame Glücksspielbehörde der Länder - the Joint Gambling Authority of the Federal States) on direct 
communication.

b. Display advertising partners (using post view/re-targeting)
Reach and retargeting partners who play display advertising as post-view and / or re-targeting require separate 
consent. Re-targeting partners use a tracking procedure. In this process, users are marked when they visit certain 
websites and then targeted with targeted advertising when they visit other sites.

c. Influencer marketing
The promotion of gambling by "influencers" via their communication platforms is currently prohibited. 

d. Streaming (marketing)
The promotion of gambling via streaming offers is currently prohibited.

Beside the regulations on the above-mentioned affiliate groups a separate application and verification by Novoline.de is 
always required.


Search Engines 

a. Affiliates are only allowed to place paid entries in search engines (e.g., Google or Bing Ads) for Novoline.de or its 
products if they have submitted a separate application, have been subjected to an evaluation and have received a 
written supplementary agreement from Novoline.de. These are explicitly stated exceptions.

b. The optimization of Affiliate websites for search engines (index), on the other hand, is welcomed. 

c. This provision equally includes new search engines and / or social networks, such as Facebook and related 
advertising systems. 


Affiliate Websites 

a. Our Affiliates are not permitted to integrate the advertising material provided on pages other than those specified 
when registering for the Affiliate Program. 

b. According to the provisions of the Telemedia Act, the Affiliates are responsible for the designation of their web pages. 
The Affiliate undertakes to use the advertising media only on designated pages. 

c. Our Affiliates’ websites may not belong to any of the inadmissible Affiliate groups listed under “Affiliate Groups” 
and/or may not include advertising material on the associated inadmissible websites. 


Advertising Material and advertising restrictions

a. Legal gambling offers (based on a German licence (GGL) in accordance with GlüStV 2021) may not be advertised on a 
site with offers that are not permitted in Germany. The Affiliate Website may only link to gambling offers from 
operators who hold a GGL licence in accordance with GlüStV 2021. 

b. Advertising may only be displayed between 9 p.m. and 6 a.m. Editorial content, such as comparison pages, is not 
considered advertising in this context.

c. When accessing the website, the affiliate must clearly indicate its remuneration as part of a registration with the 
gaming providers.

d. Novoline.de provides its Affiliates with advertising material (e.g., text links, banners) via the Affiliate Network platform.
Our Affiliates may use them exclusively on their own responsibility and within the context of their cooperation with 
Novoline.de. After termination of the partnership or at the request of Novoline.de, the advertising material must be 
immediately and completely removed from the Affiliate’s pages.

e. The Affiliates undertake to include the advertising material provided on their websites without any modifications. If the 
advertising material provided is not sufficient and additional materials are required or if a different integration of the 
advertising materials is intended, Novoline.de’s consent must be obtained. 

f. The integration of the advertising material on pages that contain radical, political, racist, discriminatory, violence 
glorifying, sexist, inciting or pornographic content or that refer to such pages as well as pages with content that 
violates good morals and applicable laws or the rights of third parties is not permitted. 

g. The integration of the advertising material on pages which predominantly target minors (under 18 years of age), 
advertise to minors or contain content aimed at minors is not permitted. 

h. Only registrations that are preceded by a voluntary and deliberate click by the user are eligible for commissions. In 
particular, the use of cookie dropping, iFrames, advertising in layers and pop-ups or the like is prohibited. 

i. When stating prize amounts or winning opportunities, even when integrated into an advertising medium, our Affiliates 
undertake to always reproduce the information truthfully and correctly. Moreover, false statement s about the chances 
of winning are not permitted. 

j. The advertisement must always be accompanied by the following disclaimer (addiction notice) if it is not already 
included in the integrated advertising material. For texts that are displayed in black on white background, 1/10 of the 
advertising media area must be observed; for other color combinations, 1/5 of the advertising media area must be 
observed.

In exceptional cases, when the space for the detailed disclaimer is not sufficient to ensure its readability in the 
abbreviated form:

„Teilnahme ab 18 | Lizensiert (Whitelist) | Glückspiel kann süchtig machen | buwei.de“

Translation: “From 18 years | Licensed (Whitelist) | Gaming can be addictive | www.buwei.de“

k. Advertising with emotional triggers is prohibited, e.g. jingling coins on slot machines.

l. Promotional e-mails may only be sent to recipients who have given their express consent to receive gambling 
advertising or have declared their interest in gambling advertising; prior to sending, the addressees must be checked 
against the blocking file (OASIS) pursuant to Section 5 (5) GlüStV 2021.

m. The partners shall ensure that the requirements regarding advertising are passed on to the responsible persons within 
their organization.


Liability 

a. If our Affiliates violate the obligations arising from these Terms and Conditions of Participation, their entitlement to 
commission shall be forfeited. In individual cases, Novoline.de also reserves the right to immediately exclude an 
Affiliate from the Program. The Affiliate shall indemnify Novoline.de against all claims by third parties that have arisen 
as a result of the Affiliate’s breach of the Terms and Conditions of Participation. 

b. If the Terms and Conditions of Participation are not observed, Novoline.de reserves the right to claim compensation 
from the Affiliate for any damage incurred by Novoline.de. 

c. In order to avoid claims for damages due to violations, Affiliates are requested to consult with Novoline.de in cases of 
doubt.


Duration of the Agreement and Termination 

Novoline.de may terminate the cooperation with the Affiliate at any time with immediate effec t if the Affiliate violates the 
General Terms and Conditions of Participation of the Affiliate Program. After termination of the cooperation, all advertising
materials and links from the Novoline.de Affiliate Program must be returned, destroyed or permanently deleted without 
delay and thus removed from the Affiliate’s website. At the latest, however, this must be done after 24 hours.


Changes to the Terms and Conditions of Participation 

We will inform our Affiliates of any changes to these Terms and Conditions of Participation by e -mail in good time. After 
the information on the changes has been sent, the change shall be deemed to have been approved if the Affiliate does not 
object in writing or by e-mail within four weeks of receipt. Novoline.de will apply the amended version of the Terms and 
Conditions to the Affiliate Program if no objection is made. If an objection to the changes is made, the objection shall be 
considered a termination of the Affiliate Program. 


Special Obligations 
The Affiliate undertakes to prevent any damage to Novoline.de by complying with the obligations arising from these Terms 
and Conditions of Participation, the framework conditions of the GlüStV and the associated other statutory provisions. In 
particular, the Affiliates commit to supporting the prevention of addiction and the protection of minors. 


Final Provisions 

a. If any provision of these Terms and Conditions of Participation is invalid, the remaining provisions shall remain 
unaffected thereby. 

b. The invalid provision shall be replaced by the corresponding statutory provision.

c. Of the different language version of these general terms and conditions of Participation of the Affiliate Program, the 
German version shall prevail in the event that there are differences between the language versions

Conditions to the Affiliate Program if no objection is made. If an objection to the changes is made, the objection shall be
