Program-Specific Terms and Conditions of the Mediaform Affiliate Program 1. Partner's Obligations Regarding Advertising Space and Advertising Activities1.1 The partner is expressly prohibited from the following advertising activities: advertising by phone, advertising by fax, advertising by email without prior consent of the recipient, setting a cookie without the customer's conscious click on an advertising material (cookie-dropping/cookie spamming), setting up so-called click farms, click spamming, or DDoS attacks, advertising through Paid4 pages, advertising through banner networks. Any attempts at fraud are not allowed and will be promptly canceled, and the partnership terminated.1.2 The partner is prohibited from generating commissionable transactions by providing false information or through any other form of deception.  2. Other Requirements for Advertising Space and Advertising Activities2.1 Keyword Advertising: Keywords using strings that contain Mediaform's protected trademarks and/or product names, including possible misspellings and combinations, are not allowed. The display URL must not contain strings that include Mediaform's protected trademarks and/or product names, including possible misspellings and combinations.2.2 Email Advertising: Emails containing Mediaform advertising may only be sent to third parties after prior written approval by ad-cons. In doing so, the publisher must comply with all legal requirements, particularly sending emails with advertiser advertising only to individuals who have explicitly consented to receiving emails with such advertising. The partner guarantees ad-cons that the respective explicit consent is documented and can be verified if necessary, and provides ad-cons with proof upon request. The placement of Mediaform advertising in emails must be clearly marked as "advertising" in contrast to editorial content. If a publisher sends pure advertising emails without editorial content, they must be labeled as such in the subject of the emails. The publisher may not set up the sender's address and the content of its emails in such a way that the recipient is under the impression that the sender of the email is Mediaform or Mediaform Informationssysteme GmbH.  3. Compensation3.1 The partner forfeits the right to commissions generated in violation of the obligations in paragraphs 1 and 2 of these additional terms and conditions.  4. Partnerships4.1 Websites with sexist, racist, or violence-promoting content will not be accepted for the affiliate program.
