General Terms and Conditions of Arkive 

These General Terms and Conditions are provided by Thuiswinkel.org and drawn up in consultation with the Consumers’ Association within the framework of the Self-Regulation Coordination Group (CZ) of the Social and Economic Council and will become operable as of 1st June 2014.

Article 1 – Definitions 

In these terms and conditions: 

  1. Supplementary agreement: A consumer acquires products, digital content, and/or services through a distance contract, with delivery by a third party or the trader. 

  1. Withdrawal period: The time frame in which a consumer can exercise their right of withdrawal. 

  1. Consumer: An individual not engaged in trade, profession, or business. 

  1. Day: A calendar day. 

  1. Digital content: Data provided in digital form. 

  1. Extended duration transaction: A contract spanning time for product and/or service delivery. 

  1. Durable medium: A means to store information for future use. 

  1. Right of withdrawal: Consumer's option to cancel a distance contract within the withdrawal period. 

  1. Trader: Individual or entity offering products, digital content, and/or services remotely. 

  1. Distance contract: Contract via distance communication means. 

  1. Technique for distance communication: Method allowing contract communication without physical presence.

Article 3 – Applicability 

  • These terms apply to trader offers and distance contracts. 

  • Terms are available to consumers prior to contract conclusion. 

  • If electronically concluded, terms provided electronically for storage. 

  • Product/service-specific terms apply alongside general terms. 

Article 4 – The Offer 

  • Offer terms, validity, and conditions clearly stated. 

  • Accurate product/service description including illustrative material. 

  • Consumer rights and obligations in relation to the offer outlined. 

Article 5 – The Contract 

  • Contract concluded upon consumer acceptance. 

  • Electronic acceptance confirmation or right to cancel prior to confirmation. 

  • Secure electronic data transfer and payment measures. 

  • Trader's right to decline contract based on consumer's ability to fulfill obligations. 

Article 6 – Right of Withdrawal 

  • Product purchase: Consumer can cancel within 14 days. 

  • Service/digital content: Consumer can cancel within 14 days. 

  • Extension of withdrawal period if information not provided. 

  • Consumer's responsibility for product handling during withdrawal period. 

Article 7 – Consumers’ Obligations in Withdrawal 

  • Consumer should handle product carefully during withdrawal period. 

  • Consumer liable for product devaluation from improper handling. 

  • No liability if trader didn't provide withdrawal information. 

Article 8 – Consumers' Exercise of Right of Withdrawal 

  • Consumer reports withdrawal within withdrawal period. 

  • Product returned within 14 days of withdrawal notice. 

  • Product returned in original condition and packaging. 

Article 9 – Traders’ Obligations in Withdrawal 

  • Trader confirms receipt of electronic withdrawal. 

  • Trader refunds consumer promptly, within 14 days. 

  • Refund via original payment method, no charge for consumer. 

Article 10 – Precluding Right of Withdrawal 

  • Clear exclusion of withdrawal for specific products/services. 

  • Transparently communicated before contract conclusion. 

Article 11 – The Price 

  • Prices remain consistent within offer period. 

  • Variable prices indicated with reference to market fluctuations. 

  • Price increases communicated and justified. 

Article 12 – Contract Fulfillment and Extra Guarantee 

  • Trader ensures products/services meet contract and offer. 

  • Extra guarantee doesn't affect statutory consumer rights. 

Article 13 – Delivery and Implementation 

  • Trader handles orders and service applications with care. 

  • Delivery to consumer's provided address. 

  • Prompt delivery or notice of delays, refund for delays. 

  • Risk until delivery, unless agreed otherwise. 

Article 14 – Extended Duration Transactions: Duration, Termination, and Prolongation 

  • Consumer can terminate open-ended contract with one month notice. 

  • Fixed-term contract can be terminated with one month notice. 

  • Contract's duration, termination, and prolongation clearly defined. 

Article 15 – Payment 

  • Payments within 14 days of contract or withdrawal commencement. 

  • Advance payments can't exceed 50% of product cost. 

  • Consumer notifies trader of payment inaccuracies. 

Article 16 – Complaints Procedure 

  • Trader has publicized complaints procedure. 

  • Consumer reports complaints promptly. 

  • Trader responds within 14 days, with possibility of extension. 

  • Dispute resolution includes formal complaints. 

Article 17 – Disputes 

  • EU customers can escalate complaints to European Commission Online Dispute Resolution.
